Aid for homeless is street legal-But plan for free centre nixed

He doesn't look like Santa Claus, not the department store variety anyway, with no hint of a white beard or red suit or even promises of gifts to disperse.

Instead, he's an unlikely St. Nick -- a disabled lawyer from India who lives in a small apartment in the Beach and spends his good days -- when the tremors in his hands aren't too bad -- walking the streets and dispensing free legal services to the homeless and destitute.

In these days of doom and gloom, of markets crashing and companies firing, Mukhtiar "Mark" Dahiya is an inspiring rare breed -- a lawyer who doesn't want to be paid.

The 57-year-old is determined to make you forget every nasty assumption you've ever had about the legal profession. "People call them parasites," acknowledges the outspoken lawyer who hails Mahatma Gandhi as his inspiration. "In India, my professors taught us that the law profession is not a business, it's nation-building."

Instead, he believes it's become too much of a cutthroat business that leaves the most vulnerable clients behind. Lawyers used to volunteer to provide free legal aid to the poor but, in 1967, when the demand proved too much, Ontario launched the Legal Aid system to reimburse lawyers for their time. Today, though, the system is badly underfunded and fails to reach all who need assistance.

"The Charter says we are all equal," Dahiya argues as he pleads his case in a neighbourhood coffee shop. "If we are equal, why are there homeless people who can't get legal help? We should scrap the Charter if we don't uphold it, if we don't respect it."

Legal Aid once had HARP, the Homeless Access and Referral Partnership project, which it ran through five homeless shelters, but that has been discontinued. Dahiya says many of the homeless he meets in his walkabouts have small legal problems, from shoplifting charges to police harassment, and they don't know how to access help when they don't have an address or identification.

"On occasion," Dahiya wrote in his letter last May to the Law Society of Upper Canada, "they commit suicide in the streets because small problems may appear insurmountable to them because of their poverty, health and lack of legal help."

And that is why he became determined to become a volunteer lawyer.

In 1995, he left his legal practice and his wife and two daughters in India to find them a better life in Canada. He went to law school in Ottawa to achieve his Ontario degree but, before he could write his bar admissions exam, he was in a car accident that left him injured, lethargic and unable to continue.

His marriage back in India suffered and his family never did join him. His hands tremble and his doctor warns that it will only get worse. There are days when he doesn't have the energy to leave his apartment.

Dahiya found the only thing that got him back on his feet was offering legal advice to the homeless he encountered on the street. "It is therapy to me," he explains. "My health improved because of these people."

After years of helping others -- and sometimes angering police and politicians in the process -- he was inspired to finally take his bar exams. In September 2006, Dahiya became a proud member of the Law Society, with his goal to finally be able to represent his homeless clients in court. "I don't want to be paid. I'm an old man on disability. I don't need the money."

But Dahiya soon found an obstacle to his selfless plan.

Paying the Law Society's high licence and insurance fees were unmanageable for someone offering his services pro bono. He appealed to the law society and, in June, they amended their bylaws so that non-practising lawyers who provide free legal services through Pro Bono Law Ontario can have their fees waived.

Dahiya was overjoyed. He had grand plans to formalize his outreach legal services by moving to a donated storefront that he would call City Law Centre. "People don't trust you if you don't have an office," he says with a laugh. "They think I'm a police officer."

But when he went to a training seminar run by Pro Bono Law Ontario last week, he discovered the bureaucratic fine print. It seems his insurance and license fees are covered only if he's working for free through an approved charity or non-profit group -- not on his own.

"You have to get into the old system that has already failed people," he argues. "They're only making it more difficult to do what I want to do."

And so for now, his plans to play legal Santa to the homeless have been placed on ice.
